Terms of Use

1. Parties and acceptance

These Terms are between AppHub (ABN: 81 241 568 805) and the person or organisation accessing AppHub. By accessing or using AppHub, you agree to these Terms on behalf of yourself and, where applicable, your organisation.

If a separate written agreement applies to your organisation's use of AppHub, that agreement prevails to the extent of any inconsistency.

2. Definitions

• AppHub means the hosted platform, application catalogue, administration surfaces, and related public pages.
• Customer Data means data, content, files, records, and personal information submitted to, stored in, or processed through AppHub by or for a customer.
• User means a person who accesses AppHub through an account, invitation, public form, or other authorised workflow.
• Hosted Application means a modular application made available through AppHub.

3. Eligibility, accounts, and access grants

You must use AppHub only through authorised accounts, invitations, or public workflows. Access to applications is granted explicitly and may be changed, suspended, or removed.

You are responsible for keeping credentials confidential and for activity under your account unless caused by our failure to meet our obligations under applicable law.

4. Acceptable use

• Do not attempt to bypass authentication, authorisation, organisation boundaries, rate limits, file scanning, or security controls.
• Do not upload malicious code, unlawful content, or data you are not authorised to provide.
• Do not use AppHub to interfere with the platform, other customers, subprocessors, or public infrastructure.
• Do not reverse engineer, scrape, overload, or probe AppHub except as expressly authorised in writing.

5. Customer Data and ownership

As between you and AppHub, Customer Data remains owned by the customer or the relevant rights holder. You grant AppHub the rights needed to host, secure, process, display, transmit, back up, and support Customer Data for AppHub.

You are responsible for ensuring you have the rights and notices required to provide Customer Data to AppHub, including personal information.

6. Fees and billing

Fees, billing terms, taxes, payment timing, service credits, and enterprise service levels are governed by a separate quote, order form, statement of work, or signed agreement. These Terms do not create a standalone obligation to provide paid services without an agreed commercial arrangement.

7. Intellectual property

AppHub and its licensors retain all rights in AppHub, including platform code, design, documentation, templates, and generic know-how. No rights are transferred except as expressly stated in these Terms or a separate written agreement.

Feedback may be used to improve AppHub without restriction or obligation, provided we do not disclose Customer Data or personal information contrary to our obligations.

8. Third-party services and subprocessors

AppHub uses third-party providers to deliver the service, including Supabase for database and authentication hosting, and Cloudflare for edge compute, content delivery, and Turnstile bot protection.

9. Availability, support, and beta features

AppHub is provided on an as-is and as-available basis to the maximum extent permitted by law. Some features, applications, previews, reports, or beta surfaces may change, be withdrawn, or contain errors.

Published support targets are best-effort and non-binding unless expressly included in a signed enterprise agreement. See Support.

10. No reliance on application outputs

Dashboards, calculations, ROI figures, exports, summaries, and other application outputs are informational only. They are not legal, financial, tax, accounting, security, or professional advice.

You are responsible for validating outputs before relying on them for business, compliance, investment, reporting, or operational decisions.

11. Privacy and security

AppHub handles personal information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply. See Security & Privacy for a plain-language summary.

12. Suspension, termination, export, and deletion

We may suspend or restrict access where reasonably necessary to protect security, privacy, platform integrity, other users, or legal compliance, or where required by a commercial agreement.

On account or organisation termination, data export and deletion will be handled according to the applicable agreement and operational feasibility. Some records may be retained where required for audit, security, dispute resolution, backup, or legal purposes.

13. Liability and non-excludable rights

Nothing in these Terms excludes, restricts, or modifies rights that cannot be excluded under the Australian Consumer Law or other applicable laws.

To the maximum extent permitted by law, AppHub excludes implied warranties and is not liable for indirect, special, consequential, exemplary, or punitive loss, lost profits, lost revenue, lost goodwill, or loss of data, except to the extent caused by rights or obligations that cannot be excluded.

14. Indemnity

You indemnify AppHub against claims, losses, liabilities, costs, and expenses arising from your unlawful use of AppHub, unauthorised Customer Data, breach of these Terms, or infringement of third-party rights, except to the extent caused by AppHub's breach or negligence.

15. Changes

We may update these Terms from time to time. The Last updated date identifies the current published version. Continued use after a change means you accept the updated Terms, unless a separate agreement sets a different change process.

16. Governing law and contact

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the courts of New South Wales and the Commonwealth courts of Australia.
